How can we achieve an appropriate description of the infringements over the Network, especially taking into account their instrumental role regarding other infringements, e.g. the so-called identity theft to commit a scam?
How do we conciliate the privacy rights, that implies a certain "right" to anonimous navigation on the Network, with the need to produce and use digital evidence?
What should be the roles of Public Administrations and the role of Civil Society in the fight against fraud other that criminal offenses, such as electronic abuse agains consumers or worker, or the illegal share of contents protected under intellectual property?

The group adresses the object of analysis around the complex problems that arise from the current legal framework related to the fight againts all forms of electronic fraud (being criminal offenses or not), particularly taking into account the difficulties in describing the activities that coinstitute an infringement (e.g. identity theft vs identity fraud) and the need for a national and internations cooperation framework that contribute to an effective and efficient fight against a particular infringement. Additionally, the working group will tackle the digital evident problem, an element that must be adequately treated in the context of the privacy laws, to arrive to an equilibrium between the rights of the affected parties and the right to access to the judicial process.
